Terms and Conditions for Naga Panchami at Sadhguru Sannidhi, Bengaluru

These Terms and Conditions (“Terms & Conditions/Terms”) are legally binding between you ("You") and Shri Yogini Trust (“We” or “Us”) for your registration to participate in the “Naga Panchami at Sadhguru Sannidhi” (“Event”) on Naga Panchami each year. Please see the exact date for the Event on the Site.

You agree that by registering for this Event and accessing this website www.isha.sadhguru.org (“Site”), You have read, understood, and agreed to be bound by these Terms & Conditions. If You do not agree with all of these Terms, then You are expressly prohibited from using the Site and You must discontinue its use immediately.

You hereby represent and warrant that You are competent to enter into these Terms. You confirm that You have read, understood and agreed to these Terms. We reserve the right to revise the Terms & Conditions at any time and at our sole discretion. 

1. User Registration: 

1.1   There is no age limit to participate in this Event. But no one under 18 years shall register for the Event on his/her own.

1.2 To register for the Event, You must provide complete and accurate details/information as asked for in the registration page.

1.3 Your registration for the Event will be complete only after You receive a confirmation email, confirming Your registration and participation.

1.4 The Event registrations are subject to availability.

1.5 You confirm that You are an Indian accessing the Site from within the territory of India.

1.6 If Your child under 18 years old is accompanying You to the Event, You will be responsible for their supervision and safety.

1.7 You can register for participation for yourself only, i.e., You will be considered the booker who completed the booking. In case the participant is a different person from the booker, the Terms and Conditions need to be accepted by the participant prior to participation in the Event, and the booker will ensure this.

2. Payment:

The payment must be made in full, according to the chosen category, before the commencement of the Event.

2.2 We accept the following mode of payments, i.e., Debit / Credit Cards, Net Banking, e-Wallets and UPI.

Refund Policy:

i) No refund will be provided for Ananta category of participants.

ii) For Vasuki, Shankapala and Sesha category of participants, if a refund request is received on or before 25th July 2025, 20 percent Event fee will be deducted as cancellation charges.

iii) No requests for refund will be accepted after 25th July 2025, or for a no-show, or for incomplete attendance of the Event.

iv) In case of multiple participants registering together as a group, only the booker can request for a refund, cancellation or upgrade. Partial or single participant cancellation in a group booking is not possible.

Please Note:

All refund and cancellation requests should be sent in writing to ssb.programs@sadhguru.org from the registered email ID of the person who completed the booking. No other mode of communication will be accepted.

The effective start date for processing the refund will be from the formal receipt of the cancellation notification in writing with supporting documents where applicable.

The refund request will be processed within 30 days from the date of request from the registered email ID of the person who completed the booking.

In case You are not allowed to continue the Event due to medical reasons or code of conduct, no refund can be claimed.

The refund will be made to the same mode of payment/instrument from which the original payment was made.

Transfer Policy:

Given the nature of the unique event, transfer to a future Event is not allowed.

Upgrades:

Only the booker can request an upgrade.

An upgrade can be processed for the entire group only after cancellation of the previous booking.

Partial or single participant upgrade in a group booking is not possible.

3. Medical Guidelines:

3.1 You shall ensure that all the information provided is true and complete.

3.2 You must carry Your regular medications while attending the Event.

3.3 In the event of a medical condition arising during the Event, You agree to abide by the recommendations made in Your best interests by the medical team in charge of the Event. This might include taking medications, referral to a nearby hospital for further care, discontinuing the Event or leaving the Event venue.

3.4 If You do not comply with the recommendations of the medical team, You will be requested to discontinue the Event.

4. Disclaimer Regarding Third-Party Websites.

The Site is provided on an as-is and as-available basis. You agree that Your use of the Site services will be at Your sole risk. To the fullest extent permitted by law, We disclaim all warranties, express or implied, in connection with the Site and Your use thereof, including, without limitation, fitness for a particular purpose and non-infringement. We make no warranties or representations about the accuracy or completeness of the Site’s content or the content of any websites linked to this Site and We will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage, of any nature whatsoever, resulting from Your access to and use of the Site, (3) any unauthorized access to or use of Our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the Site, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Site by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Site. We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third-party through the Site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and We will not be a party to or in any way be responsible for monitoring any transaction between You and any third-party providers of products or services.  The terms and conditions provided in the third-party website would be applicable for your transactions on those websites. Your interaction with this website does not mean that the terms of the third-party website are not applicable for your transaction therein.

5. Code of Conduct: 

You agree to behave in such a way as to create a safe, supportive, learning environment while at the Event. You shall comply with the following:

Dress Code - Both men and women should wear clothing that covers shoulders, upper arms, midriff, and legs down to their ankles. Tight or transparent clothing should not be worn.

Behaviour - You are expected to uphold the sanctity, serenity, and safety of the Venue through respectful and lawful conduct at all times. You are required to comply with all applicable laws and adhere to a strict code of ethical and personal behavior. Any act of assault, harassment (including verbal, physical, emotional, or sexual), child abuse, sexual misconduct, stalking, exploitation, or any other form of unlawful, unsafe, or disruptive behavior is strictly prohibited. Discriminatory or offensive speech or conduct—whether explicit or implied—based on race, caste, gender, sexual orientation, religion, nationality, age, or disability will not be tolerated under any circumstances.

Consumption - You agree not to smoke, drink alcohol or consume any hallucinogenic or banned drug at the Venue premises.

Consequences - Participants engaging or threatening to engage in such behavior will be asked to leave the Event immediately, and such Participants will not be eligible to receive a refund of any fees paid towards their participation in the Event. If You witness such behavior mentioned above, please promptly contact the Event Volunteers in order to take appropriate action. We reserve the right to initiate legal action or follow the due process of law, if You violate the code of conduct or any laws.

6. Assumption of Risk: 

You acknowledge and agree that Your attendance and participation in the Event is voluntary. You agree to assume the risks associated with attending and participating in the Event to the fullest extent permitted under applicable law.  To the extent permissible by law, You agree to indemnify Us against any and all claims, actions, losses and damages arising out of or relating to Your participation in the Event.

7. Information About You:

You consent to the collection and use of Your personal information that You provide in connection with the Event, by Us.  We will use Your information to send details and announcements related to the Event and our other offerings to You. Any personal information that You provide to Us online will be handled in accordance with the laws and regulations of India. We are committed to protecting Your personal information and Your right to privacy. Our Privacy Policy governs the privacy policies of Our Site. You agree that We may use any information that We obtain about You in accordance with the provisions of Our Privacy Policy. Please read Our Privacy Policy carefully as it will help You make informed decisions about sharing Your personal information with Us.  You may be contacted in the future regarding this event or other events and offerings we organize. If you prefer not to receive such information, please email us using the contact details provided.

8. License to Use Items: 

In consideration of the opportunity to participate in the Event, You grant Us an irrevocable, non-exclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for promotional / educational purposes, all or any part of the following items ("Items"): (a) all still photographs (b) all audio and video recordings in connection with the Event. You consent to the use of the Items pursuant to the foregoing in perpetuity without compensation (unless prohibited by law) or additional consents from You and waive any moral rights You may have in the Items.

9. Waiver of Liability:

In consideration of being allowed to register for, and participate in the Event, You freely waive, release from liability, assume all risks, and covenant not to sue Us or Our members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, disability, property damage, or property theft or actions of any kind that You may hereafter suffer or sustain before, during, or after the Event, unless said expense, loss, damage, personal injury, including loss of life, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of Us. This Waiver of Liability is specifically binding upon Your heirs and assigns and is knowingly given by You.

10. Force Majeure: 

In the event that it is made impossible or impracticable or illegal for Us to proceed with or carry out this Event in whole or in part, due to any natural calamity, general or specific order of government, fire, casualty, flood, earthquake, war, strike, demonstrations, lockout, pandemic, epidemic, destruction of its facilities, riot, insurrection, materials unavailability, or any other cause(s) beyond Our reasonable control, and as a result thereof, We may delay, postpone, reschedule, terminate and/or cancel this Event, We will not be liable for any losses or damages incurred by the Participant.

11. Governing Law and Dispute Resolution:

Any and all controversy(ies) / disputes) / difference(s)/ claim(s) / claim(s) in tort arising out of or in connection with or in relation to this Terms and Conditions, including its existence, validity or termination, shall be referred to and finally resolved by arbitration of sole Arbitrator nominated by the Council for National and International Commercial Arbitration (CNICA), having its registered office at Unit No.208, Raheja Towers, No:113-134, Anna Salai, Chennai 600002 as per CNICA Online Dispute Resolution (ODR) Rules and conducted under online platform www.cnica-odr.com. The arbitration must follow the ODR process and CNICA-ODR Rules shall prevail. All matters in the arbitration shall be governed by the Arbitration and Conciliation Act, 1996. 

The place of arbitration shall be Chennai and the language to be used in the arbitration proceedings shall be English. The award of the arbitration proceedings will be final and binding on both Parties to the Agreement.

These Terms and Conditions shall be governed by, subject to and construed in accordance with the laws of India.

12. Limitations of Liability:

In no event will We or Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees be liable to You or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from Your use of the Site, even if We have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Our liability to You for any cause whatsoever and regardless of the form of the action will at all times be limited to the cost of the Event.

13. Indemnification:

You agree to defend, indemnify, and hold Us harmless, including Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of Your participation in the Event and/or breach of these Terms & Conditions. 

Notwithstanding the foregoing, We reserve the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify Us, and You agree to cooperate, at Your expense, with such claims. We will use reasonable efforts to notify You of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

14. Miscellaneous:

14.1 The Terms & Conditions listed herein are subject to change from time to time. Any modifications to the "Terms & Conditions" will be posted on the Site and shall be notified to You through email. The modified Terms & Conditions shall also be binding upon You.

14.2 The Event is subject to changes as per the directions issued by the Government and the local health authorities from time to time.

14.3 You agree that Your failure to adhere to any of the Terms & Conditions set out above or any other provision of these Terms & Conditions shall constitute a breach of these Terms & Conditions on Your part, which may result in the termination of Your access to the Site and/or participation in the Event.

14.4 If any provision or part of a provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms & Conditions and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between You and Us as a result of these Terms & Conditions or use of the Site.

14.5 You agree that these Terms & Conditions will not be construed against Us by virtue of having drafted them.
