Terms and Conditions

This notice is issued by the Isha Nepal (“Service Provider”)

AGREEMENT TO TERMS

These Terms of Use ("Terms of Use") apply to the Inner Engineering website located at innerengineering.sadhguru.org (the “Site”). The Site is the property of Isha Foundation. By using the Site, you agree to these Terms of Use. If you do not agree, do not use the Site. You hereby represent and warrant that You are competent and of legal age to enter into these Terms and confirm that You have read, understood and agreed to these Terms.


DETAILS OF PROGRAM REGISTRATION FOR INNER ENGINEERING PROGRAM ("Online"):

  1. USER REGISTRATION

  • Minimum age requirement for your participation in the program is 15 years. If you are under the age of 18, parental approval is required.

  • In order to participate in the Program, you may be required to register and create an account on the program portal. You will receive a confirmation of your account’s creation through the email address you provide during registration.

  • When you register for the Program, you are agreeing to: (i) provide true, accurate, current, and complete information about yourself and (ii) maintain and promptly update your registration information to keep it true, accurate, current, and complete.

  • We have a right at our sole discretion to immediately suspend or terminate your account and refuse any and all current or future participation in the Program (or any portion thereof) if You provide any information that is untrue, inaccurate, not current, erroneous or incomplete; or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete;

  • You are responsible for maintaining the confidentiality of your account credentials and shall not share it with anyone.

  • Your registration for the Program will be complete only after You receive an email confirming Your registration and participation.

  • The Program registrations are subject to availability and we shall not be liable in case You are not able to register for the Program.

  • This Program is open only for Indian Participants and only Indian modes of payments will be accepted.

  • Once you select a language during registration, it cannot be altered, and no refund will be given for such language changes.

  • Kindly note that only English and Tamil language Programs are in the voice of Sadhguru. This Program has been dubbed in all the other languages in Our efforts to make this possibility available to all.

2. PROGRAM GUIDELINES

Below are a few guidelines to ensure you receive the program in its totality and integrity:

  • The Inner Engineering Program (Online) consists of 7 steps.  The first 6 steps are self-paced and can be taken as per your convenience.

  • The 7th step involves the transmission of the powerful Shambhavi Mahamudra Kriya. This is offered live only on select dates.  

  • Because this is a step-by-step process, you will not be able to attend the subsequent session if you miss or drop out of any of the previous sessions.

  • To take part in Shambhavi Mahamudra initiation (Step 7, session 2), you must complete the first 6 steps, and attend Session 1 of Step 7. Multiple dates will be available to take part in Initiation.

  • It is optimal to complete the 6 self-paced steps within 7 days, and attend the Transmission of Shambhavi Mahamudra Kriya the next available weekend. However, if this is not possible, please ensure that you complete the program through Step 6 within a maximum of 30 days after your registration date.

Due to the nature of the program and to allow for an experience as close to the live programs as possible, each step is designed to be watched only once. However, to ensure seamless experience and to support you go through each step in its entirety, we are offering a one-time rewatch upon request,  for steps 1-6. Please note that, it's possible to re-watch a step only once. This is not applicable for  Step 7.

Technical Requirements:

Hardware requirements (Mandatory): - You will need compatible hardware, such as: 

  • Laptop/desktop computer or iPad / Tablet, compatible with the latest version of Chrome (recommended), Firefox, or Safari browsers.

  • A functioning webcam (inbuilt or external).

  • Mobile phones are also supported. The Sadhguru App needs to be downloaded. (Android version 7 and above; IOS version 12.4 and above)  

  • Stable internet access with sufficient bandwidth of 2.5 Mbps / adequate data pack

  • Operating System: Windows 8 or later (or) Mac OS X El Captain 10.11 or later, some Linux versions, iOS 13 and above for iPads, and Android version 9 and above for tablets.

  • Speakers (any kind of headphones or devices in touch with the body may not be used)

  • Expected Data usage is 500 Mb / hour.

  • Wi-fi or wired internet connection is recommended. You can check your bandwidth here (link).

Ensure to keep your phone on Do Not Disturb during the program. Please ensure that the device you use for the Program is charged to ensure minimal interruption.

Before beginning the Program, please make sure that all of your hardware and software are completely functional. The Isha Foundation is not liable for any device or network problems or service interruptions that may occur during your session.

Please be aware that photographing, screen-shotting, screen-recording, and/or recording any part of the Program, whether by video or audio, for any reason is strictly banned. To learn more, please visit our Intellectual Property Rights section.

PROCTORING / MONITORING

For the Step-7 (Transmission of Shambhavi Mahamudra), you agree to allow a proctor to monitor your participation in the Program by accepting this agreement.

When you join Step 7 (Transmission of Shambhavi Mahamudra) of the programme:

  • You must keep your camera turned on during the session and be fully visible on video so that the proctor can assist you when needed.

  • Make sure the room is well lit so that your face is visible.

  • This is necessary so that we can assist you during the session.

  • During the session, you must maintain chat and video contact with the proctor.

  • You understand and agree that the proctor will not record anything throughout the session or during any contact between the participant and the proctor.

If necessary, you agree to grant a proctor visual access/inspection of your premises.

If the proctor encounters or observes any activity that is deemed vulgar, insulting, abusive, criminal, or otherwise improper, or not adhering to the guidelines of this program they reserve the right to discontinue your participation.

CREATING A CONDUCIVE ATMOSPHERE

  • Please login at least 20 minutes before the start of each session.

  • It is critical that you sit alone in a quiet, secluded area for the duration of the session.

  • Please make sure there are no external interruptions or distractions (like using the restroom, taking calls, or checking messages). If you have children or pets who may cause you to be disturbed, please make sure they are well cared for.

  • If you have family members who have registered for this programme, please make sure they are in a separate physical space and that each of you has logged in to the sessions independently, through different devices.

  • It's best to sit on the floor and make sure you have enough space (about 3ft x 6ft) to do the yogic practices. You can use a chair if you have a physical condition that prevents you from sitting on the floor.

  • Please dress comfortably so that you can sit on the floor and complete the practice comfortably.

  • Please bring a yoga mat or a bed sheet.

  • Please keep an empty stomach for the duration of the session, which implies a four-hour gap between your last complete meal and the start of the session. During the sessions, please do not eat or drink anything.

3. HEALTH GUIDELINES

The material given on or through the Site, as well as the programme offered, are not intended to replace professional medical advice and treatment.

Contact your medical or mental health specialists before registering for the Program if you have or suspect you have a medical or mental health concern.

Prerequisites for the Program in terms of health:

  • Before beginning the Program, you must agree and accept the medical disclaimer.

  • You must have received previous consent from your physician/doctor to participate in the Program.

You must notify us as soon as possible if you develop any of the following health issues after registering:

  • Suffering from a [new] injury, disease, or other medical ailment

  • During a yoga lesson, if you experience any pain or discomfort.

  • If you feel any of the exercises in a yoga class would be dangerous or uncomfortable for you.

If we believe your health situation does not allow you to participate in the Program, we have the right to exclude you from the Program at our sole discretion.

Injuries or benefits: The Program is exempt from any representations, warranties, undertakings, and guarantees. We make no representations, warranties, undertakings, or guarantees that you will not be injured as a result of participating in our Program, either directly or indirectly; or that your fitness will improve measurably as a result of participating in the Program.

4. PAYMENT

  • Debit/credit cards, Net banking, and UPI are the payment methods we accept.


We have the right to revoke your registration if any of the requirements outlined in this agreement are not met. The cancellation, refund and reschedule policy applies to all refunds.

5. REFUND, CANCELLATION, RESCHEDULE & TRANSFER POLICY:

Refund Policy:

  • Participants who have registered for the Program can apply for a refund only if they have NOT ACCESSED the course and within 30 days from the date of registration and payment. After 30 days from the date of registration and payment, and/or once you start the Program, there is NO REFUND.

  • If a refund request is received before starting the  Program, and within 30 days from the date of registration and payment  , 90% of the program fee will be refunded. In case of any discount applicable on the Program fees, 90% of the discounted fee shall be refunded.  You will be able to avail the discount only when the same is announced by Us. 

  • The request for refund should come from your registered email id to info.nepal@isha.sadhguru.org

  • Participants who have registered for the Program by using a gift coupon are not eligible for a refund.

Reschedule Policy:

Please note that the reschedule policy is applicable only to Step 7, Transmission of Shambhavi and is subject to availability of Step 7 dates at the time of rescheduling. 

  • Participants will have either a total of 3 chances to reschedule their Step 7 dates, or 1 year from the date of registration to complete the program, whichever comes first.

  • If you are unable to complete Step 7 Transmission of Shambhavi within 1 year from the date of registration, OR if you have exhausted all 3 reschedule chances, you will have to re-register by paying 50% of the current program fee without any special discount to reactivate your account.

  • Once you reactivate your account by paying a 50% program fee, you will again have 1 year from the date of reactivation or 3 reschedule chances (whichever comes first) to complete the program. 

  • You will start the program from the step you were on once the account is reactivated. 

Transfer Policy:

  • You can transfer to any of the following Isha Yoga programs happening at the Isha Yoga Center, Coimbatore, India subject to availability of the seats only if you have NOT ACCESSED the  Program. You shall pay a transfer fee equivalent to 15% of the program fee (15% fee of the Program you are transferring to) and you shall also pay the difference in program fees, if any:

  • Inner Engineering Retreat

  • Yoga Asanas

  • Surya Kriya

  • Angamardana

  • For all transfers, the program is to be taken within one year from the date of  original registration.

  • You can transfer only once.

  • The registration is non transferable to another person.

  • Participants who have registered for the Program using a gift coupon are not eligible for Transfer to another person or any other program. 

We reserve the right to revise the terms and conditions of this Agreement at any time and at our sole discretion.

6. ADMISSION:

We reserve the right to allow admission into the Program and/cancellation of Your participation at Our sole discretion.

7. VOLUNTARY PARTICIPATION

The Participants  acknowledges that participation in the  Programs and visiting our site is done voluntarily and that you alone are 100% solely and personally responsible for your participation in our site, Programs and for any outcomes or results that result therefrom (whether positive or negative). You acknowledge that you have or will use your own due diligence and judgment before implementing any knowledge or information you received from our site, Programs. Isha Foundation is not responsible for any action you may choose to take regarding the information provided, and you acknowledge and agree that we are not responsible nor liable to you should you sustain any financial harm, physical injuries or any negative ramifications. The Participants acknowledges that the information contained on this site is intended as general information only and you agree that any decisions you make to implement or follow anything you find on the site are wholly your own.

INTELLECTUAL PROPERTY RIGHTS

Unless otherwise stated, the Site is our property, and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site (collectively, the "Content"), as well as the trademarks, service marks, and logos contained therein (collectively, the "Marks"), are owned by Isha Foundation and are protected by copyright and trademark laws, as well as various other intellectual property rights.

The Site's Content and Marks are provided "as-is" for your convenience only. No part of the Site, including the Content and Marks, may be copied, reproduced, aggregated, republished, uploaded, publicly displayed, encoded, translated, transmitted, distributed, downloaded, edited, broadcasted, transferred, used, sold, licenced, or otherwise exploited for any commercial or non-commercial purpose.

PROHIBITED ACTIVITIES WHILE USING THE SITE

You may not access or use the Site for any other purpose than the one for which we provide it. The Site may only be used in connection with commercial ventures that we have officially endorsed or approved.

You agree as a user of the Site not to:

Without our written authorization, systematically retrieve data or other content from the Site in order to establish or compile, directly or indirectly, a collection, compilation, database, or directory.

Make any illegal or unauthorised use of the Site, such as gathering usernames and/or email addresses of users by electronic or other methods to send unsolicited email, or creating user accounts by automated means or under false pretences.

Advertise or offer to sell products and services on the Site.

Avoid, disable, or otherwise interfere with the Site's security mechanisms, such as those that prevent or restrict the use or copying of any Content or impose restrictions on the use of the Site and/or the Content included therein.

Unauthorized framing or linking to the Site is prohibited.

Trick, deceive, or mislead us or other users, especially if you're trying to learn critical account information like passwords.

Make unauthorised use of our support services or file fake abuse or misbehaviour reports.

Engage in any automated system use, such as sending comments or messages using scripts, or utilising data mining, robots, or other data collection and extraction tools.

Interfere with, disrupt, or place an undue burden on the Site, its networks, or services.

Attempting to impersonate another user or person, or using another user's account.

Your profile can be sold or transferred in some other way.

Harass, abuse, or injure another person using any information obtained from the Site.

Use the Site in any attempt to compete with us, or for any other revenue-generating initiative or commercial operation.

Decipher, decompile, disassemble, or reverse engineer any of the software that makes up or forms part of the Site in any way.

Attempt to go beyond any Site security measures that are in place to prevent or restrict access to the Site, or any part of it.

Harass, irritate, intimidate, or threaten any of our employees, agents, or volunteers who are providing you with access to any part of the Site.

Remove any content that contains a copyright or other proprietary rights notice.

Software from the Site, including but not limited to Flash, PHP, HTML, JavaScript, and other code, may be copied or adapted.

Upload or transmit (or attempt to upload or transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party's uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, or alters the Site's use, features, functions, operation, or maintenance.

Upload or transmit (or attempt to upload or transmit) any material that operates as a passive or active information collection or transmission mechanism, such as gifs, 11 pixels, web bugs, cookies, or other similar devices (sometimes known as "spyware" or "passive collecting mechanisms" or "PCM").

Use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or using or launching any unauthorised script or other software, except as may be the result of standard search engine or Internet browser usage.

Disparage, tarnish, or otherwise hurt us and/or the Site, in our opinion.

Use the Site in a way that violates any laws or regulations that may apply.

GUIDELINES FOR SUBMISSIONS

On the Site, we may provide sections for you to post reviews or ratings, as well as questions, comments, recommendations, ideas, feedback, or other information about the Site/Program ("Submissions"). When writing a review, you must meet the following requirements:

(1) Your Submissions must not contain offensive profanity, abusive, racist, offensive, hateful language, or illegal activity; discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability; or discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.

(2) You may not make any false, misleading, or deceptive assertions.

(3) We reserve the right to accept, reject, or remove Submissions at our sole discretion. We are under no responsibility to screen or delete Submissions, even if someone finds the reviews unpleasant or false. We do not endorse submissions, and they do not necessarily reflect our views or the views of any of our affiliates or partners.

(4) We accept no responsibility for any review, including any claims, liabilities, or losses that may arise as a result of the review. You offer us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sublicensable right and licence to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content pertaining to reviews by posting a review.

(5) You understand and agree that any information you supply to us will be considered as confidential information (all information indicated in the privacy policy will be treated as secret information) and will become our sole property. We will possess the exclusive rights to these Submissions, including all intellectual property rights, and will be free to use and distribute them for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you.

(6) You hereby relinquish all moral rights to any such Submissions and warrant that any such Submissions are your original work or that you have the authority to submit them. You acknowledge that you will have no recourse against us if your Submissions are allegedly or actually infringed upon or misappropriated.

SITE MANAGEMENT

We reserve the right but not the duty, at our sole discretion, to:

(1) keep an eye on the Site for any violations of these Terms of Service;

(2) take necessary legal action against anybody who breaks the law or these Terms of Service, including, but not limited to, reporting the offending user to law enforcement authorities;

(3) deny, limit access to, limit the availability of, or disable (to the extent technologically practicable) any or all of your Contributions;

(4) notice or liability to remove or disable all files and content from the Site that are excessively large or in any manner burdensome to our systems;

(5) otherwise manage the Site in a way that protects our rights and property while still allowing it to function properly.

PRIVACY POLICY

We are concerned about data security and privacy. Please read our Privacy Policy (link to USA team) on the Site. You agree to be bound by our Privacy Policy, which is incorporated into these Terms of Use, by using the Site.

You agree that we may use any information we receive about you in accordance with the terms of our Privacy Policy, and that you have no ownership or proprietary interest in your account except as stated in these Terms of Use.

MODIFICATIONS AND INTERRUPTIONS

We reserve the right, at our sole discretion, to change, modify, or remove the contents of the Site or to cease it at any time and for any reason. We are not obligated to update any information on our Site, however.

Any modification, price change, suspension, or discontinuance of the Site will not be liable to you or any third party.

We cannot promise that the Site will always be available. We may encounter hardware, software, or other issues, or we may need to perform Site maintenance, which may result in interruptions, delays, or errors. Without prior notice to you, we reserve the right to change, amend, update, suspend, discontinue, or otherwise modify the Site at any time and for any reason.

You acknowledge that we are not responsible for any loss, damage, or annoyance incurred as a result of your inability to access or use the Site during any downtime or discontinuation of the Site. Nothing in these Terms of Use obligates us to maintain and support the Site, or to provide any updates, corrections, or releases in connection with it.

GOVERNING LAW

These Terms of Use and your use of the Site are governed by and construed by the laws of Nepal.

DISPUTE RESOLUTION

The courts in Kathmandu, Nepal, will have exclusive jurisdiction in the event of a dispute.

If there is a discrepancy between these terms and rules and/or specific terms of use relating to specific material on this website, the latter will take precedence.

DISCLAIMER

(1) The Site is provided "as is" and "as available." You acknowledge and agree that your use of the Site's services is at your own risk. We disclaim all warranties, express or implied, in connection with the site and your use of it, including, without limitation, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We offer no warranties or claims about the correctness or completeness of the site's content, or the content of any websites connected to it, and we will not be liable or responsible for any errors or omissions.

(2) any errors, omissions, or inaccuracies in the content and materials,

(3) any personal injury or property damage of any kind resulting from your access to and use of the site,

(4) any unauthorised access to or use of our secure servers and/or any personal information and/or financial information stored therein,

(5) any interruption or cessation of transmission to or from the site,

(6) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the site,

(7) We will not be a party to or in any way be responsible for monitoring any transaction between you and any third-party providers of products or services advertised or offered through the site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and we will not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising.

LIMITATIONS OF LIABILITY

Even if we have been advised of the possibility of such damages, we, our directors, employees, or agents will not be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the site. Regardless of anything provided herein to the contrary, our responsibility to you for any reason and regardless of the type of action will always be limited to the cost of the Program.

INDEMNITY

You agree to hold Isha Foundation, its subsidiaries, affiliates, and all of our respective officers, volunteers, agents, partners, and employees harmless from any demands, loss, liability, claims, or expenses (including attorneys' fees) made against Isha Foundation by any third party due to or arising out of or in connection with your I use of the Site, and (ii) breach of these Terms of Use.

MISCELLANEOUS

The whole agreement and understanding between you and us is contained in these Terms of Use, as well as any policies or operating regulations issued by us on the Site or in relation to the Site. Failure on our part to execute or enforce any right or provision of these Terms of Use does not constitute a waiver of that right or provision.

These Terms of Service apply to the fullest extent allowed by law. Any loss, damage, delay, or failure to act caused by a cause beyond our reasonable control is not our responsibility or liability.

If any provision of these Terms of Use is found to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from the rest of the Terms of Use and has no bearing on the legality or enforceability of the remaining terms. As a result of these Terms of Use or your use of the Site, no joint venture, partnership, employment, or agency relationship exists between you and us.

By drafting these Terms of Use, you agree that they will not be construed against us.
