Terms and Conditions for In the Lap of the Master

These Terms & Conditions  (“Terms & Conditions/Terms”) are legally binding between you ("You") and Isha Foundation ("We" or "Us") for your registration to participate in “In the Lap of the Master” (“Program”) with Sadhguru. 

You agree that by registering for this Program and accessing this website www.isha.sadhguru.org ("Site"), You have read, understood, and agreed to be bound by these Terms & Conditions. If You do not agree with all of these Terms, then You are expressly prohibited from using the Site and You must discontinue its use immediately.

You hereby represent and warrant that You are competent to enter into these Terms. You confirm that You have read, understood and agreed to these Terms. We reserve the right to revise the Terms & Conditions  at any time and at Our sole discretion. 

  1. Definition:

a. "Group Registration" shall mean multiple people registering together, having one participant as a primary participant.  The participants understand that the category of Group Registration is open solely for the purpose of ease of registration.

2. User Registration: 

a. The minimum age limit to participate in the Program is 14 years. But no one under 18 years shall register for the Program on his/her own or provide any personal information in this regard without parental consent.

b. To register for the Program, You must provide complete and accurate details/information as asked for in the registration page.  

c. Your registration for the Program will be complete only after You receive a confirmation email, confirming Your registration and participation.  

d. The Program registrations are subject to availability. 

e. If You are accessing the Site from outside the territory of India, then You must be of competent age to enter into a contract as per the local laws of Your location.

3. Payment: 

a. The payment must be made in full, according to the chosen category, before the commencement of the Program. 

b. We accept the following mode of payments, i.e., Debit / Credit Cards, Net Banking, e-Wallets and UPI. 

c. In the event the prerequisites as mentioned in these Terms & Conditions are not fulfilled, We reserve the right to cancel Your registration and the refund will be done as per the Cancellation and Refund Policy provided below.

4. Refund & Cancellation Policy: 

Refunds - In person- Yogeshwara,Bhuteshwara & Kaleshwara Categories

a. If a refund request is received before 45 days of the program, 10% of the Program fee will be deducted for cancellations.

b. If a refund request is received between 44 days to 20 days before the program, 50% of the Program fee will be deducted for cancellations.

c.  No refunds , if the refund request is received between 20 days to 1 day of the program (As a deterrent so that not many refund requests are received).

The refund request will be processed within 60 days from the date of request from the registered email ID. The effective date for processing the refund will be from the formal receipt of the cancellation notification in writing with supporting documents where applicable.

Refunds - in person - for  Sarveshwara & Mahadeva Categories

There will not be any refund for the Sarveshwara & Mahadeva categories under any circumstances.

■ Refunds - in person - for Sarveshwara category (Program fee is 2500): No refund. 

■ Refunds - in person - for Mahadeva category (Program fee is 1500): No refund.
Please Note:

a. All cancellation requests should be sent in writing to lapofthemaster@ishafoundation.org. No other mode of communication for refund requests will be accepted. 

b. The effective date for processing the refund will be from the formal receipt of the cancellation notification in writing with supporting documents where applicable.

c. The refund request will be processed within 60 days from the date of request from the registered email ID.

d. In case You are not allowed to continue the Program due to medical reasons or code of conduct, no refund can be claimed.  

e. The refund will be made to the same mode of payment/instrument from which the original payment was made.

5. Upgrades: 

a. Only primary participants can request an upgrade.

b. An upgrade can be processed for the entire group or any one participant.

c. The payment for an upgrade has to be made by the primary participant only.

6. COVID-19: All guidelines and protocols in accordance with the notification / guidelines / orders issued by the government, local health officials and Us must be adhered to. You may be subject to regular medical checkups upon arrival and during the Program. 

In the event that You develop any COVID-19 symptoms during the Program, You agree to follow the protocols as may be prescribed by Us from time to time. 

6. Accommodation:  

a. The Program registration includes accommodation for the program participants for the following Categories except Mahadeva. 

Yogeshwara - Executive Twin Sharing Accommodation

Bhuteshwara - Deluxe Non-AC Twin Sharing Accommodation

Kaleswara - Non-AC Triple Sharing Accomodation

Sarveshwara - consecrated spaces of Adiyogi Alayam and Spanda hall from 12:00 PM on 22 September 2023  to 12:00 PM on 25 September 2023.

b. Each participant will be allocated either a twin-sharing or triple-sharing cottage room or dormitory stay, according to Your chosen category. 

c. If You wish to arrive early and/or extend Your visit beyond the Program dates, You may do so by booking accommodation for that period in advance. For assistance, please visit: cottage.isha.in

d.Participants who choose a non-stay category for the program (namely Mahadeva) will have to book a stay on their own. A list of stay options nearby is available on the website. Also, a link to a third-party website that displays the affordable stay options nearby will be displayed on the website.

e. In case of multiple participants registering together ("Group Registration"), the stay will be according to the category chosen for each participant. 

f. For Yogeshwara and Bhuteshwara, stay will be allocated together only if participants are of the same gender or are blood relatives or spouses. Stay will be allocated on a twin-sharing basis. 

g. For Kaleshwara category, stay will be allocated on a triple-sharing basis and will be separate for gents and ladies. 

h. For Sarveshwara category, participants will have to bring their own bedding

I. Please note that program transfer is not possible as this is a one-time program.

J. There will be no refunds for no show on the day of the program.

7. Disclaimer Regarding Third-Party Websites:

The Site is provided on an as-is and as-available basis. You agree that Your use of the Site services will be at Your sole risk. To the fullest extent permitted by law, We disclaim all warranties, express or implied, in connection with the Site and Your use thereof, including, without limitation, fitness for a particular purpose and non-infringement. We make no warranties or representations about the accuracy or completeness of the Site’s content or the content of any websites linked to this Site and We will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage, of any nature whatsoever, resulting from Your access to and use of the Site, (3) any unauthorized access to or use of Our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the Site, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Site by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Site. We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third-party through the Site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and We will not be a party to or in any way be responsible for monitoring any transaction between You and any third-party providers of products or services.  The terms and conditions provided in the third-party website would be applicable for your transactions on those websites. Your interaction with this website does not mean that the terms of the third-party website are not applicable for your transaction therein.

8. Medical Guidelines: 

a. As a prerequisite to the registration process, You will have to fill the medical declaration form.  

b. The Participant shall ensure that all the information You provide is true and complete. 

c. You must carry Your regular medications while traveling for the Program.  

d. If You are suffering from chronic health problems, such as epilepsy, heart ailments, uncontrolled blood pressure or diabetes, asthma, psychological problems, physical disabilities, it is mandatory that You mention such information, brief details about the current status and medication details in the medical questionnaire during the registration process.

e. In the event of a medical condition arising during Your stay at the Isha Yoga Center, You agree to abide by the recommendations made in Your best interests by the medical team in charge of the Program.

f. This might include taking medications, referral to a nearby hospital for further care, discontinuing the Program or leaving the Isha Yoga Center.

g. You shall bear any medical expenses that You may incur during Your stay for the Program.

h. If You experience any symptoms of COVID-19, You shall inform Us and must follow the treatment and guidelines as prescribed by Us. 

j. You fully understand the risks involved due to COVID–19 and are aware of all the regulations / safety guidelines prescribed by the Government.  You undertake that You will strictly follow the same.  You shall not hold Us responsible for Your acts of negligence in this regard and shall indemnify Us from any liability arising out of it.

k. If You do not comply with the recommendations of the medical team, You will be requested to discontinue the Program.

9. Medical Declaration:

a. I agree to provide ISHA the full and correct details of all/any of my medical conditions. In the event of any emergency or unforeseen health-related complications, I agree to abide by the recommendations made in my best interests by the medical team of Isha Yoga Center. Any medical expenses incurred in this regard will be fully borne by me.

b. If I am not in a position to communicate or decide about my treatment options, the medical team at Isha Yoga Center can decide the course of action even before my family is informed or arrives.

c. I agree to indemnify and hold Isha harmless with respect to my health, ailments or recovery during my stay at Isha Yoga Center.

d. Isha shall not be liable and does not hold any responsibility for the same.

e. I understand that the Isha Yoga Center only has a small facility for immediate health care and does not have any other facilities apart from that.

f. I understand that, due to the current COVID-19 Pandemic, Isha Yoga Center has formulated certain protocols and guidelines to prevent the spread of COVID-19 and ensure the health and wellbeing of all those who reside in the Isha Yoga Center). I hereby agree to follow all the protocols and guidelines that are already in place and those that will be formulated from time to time during my stay at the Isha Yoga Center. The guidelines will keep changing in line with the guidelines and recommendations notified by the Government from time to time in terms of symptoms, isolation, protection, and treatment protocols.

g. I understand that the Isha Yoga Center  has limited supply/variety of medications and I agree to carry all the regular medications that I would need throughout my stay at the Isha Yoga Center, including any and all prescriptive medicines and supplements, adequate for the duration of my stay.

h. I agree to carry all the protective masks/equipment/materials required in times of COVID-19 to protect myself from the infection.

i. I fully understand the risks involved due to COVID–19 and am aware of all the regulations / safety guidelines prescribed by the Government. I undertake that I will strictly follow the same. I shall not hold Isha responsible for any health-related issue including COVID–19 during my stay at the Isha Yoga Center and shall indemnify Isha from any liability arising out of the same.

j. I also agree that in the event of incomplete or false information given by me, I will not be allowed to participate in the Program or may be asked to discontinue even in the midst of the Program.

10. Admission: 

We reserve the right to allow admission into the Isha Yoga Center and/cancellation of Your participation at Our sole discretion.  

11. Code of Conduct: 

You agree to behave in such a way as to create a safe, supportive, learning environment while at the Program. You agree not to smoke, drink alcohol or consume any hallucinogenic or banned drug in the Isha Yoga Center premises. You agree not to engage in disruptive speech or behavior or otherwise interfere with the Program or other individuals’ participation in the Program. You will comply with all applicable laws and agree not to engage in any form of harassing, offensive, discriminatory or threatening speech or behavior, including relating to race, gender, sexual orientation, religion or disability. Participants engaging or threatening to engage in such behavior will be requested to leave the Program or related Program immediately, and such Participants will not be eligible to receive a refund of any fees paid towards their participation in the Program. If You witness such behavior, please promptly contact the Program Volunteers in order to take appropriate action.

12 Assumption of Risk: 

You acknowledge and agree that Your attendance and participation in the Program is voluntary. Since attending any of the sessions could involve the physical activity of learning Yoga, You agree to assume the risks associated with attending and participating in the Program to the fullest extent permitted under applicable law.  To the extent permissible by law, You agree to indemnify Us against any and all claims, actions, losses and damages arising out of or relating to Your participation in the Program.

13. Information About You: 

You consent to the collection and use of Your personal information that You provide in connection with the Program, by Us.  We will use Your information to send details and announcements related to the Program to You. Any personal information that You provide to Us online will be handled in accordance with the laws and regulations of India. We are committed to protecting Your personal information and Your right to privacy. Our Privacy Policy governs the privacy policies of Our Site. You agree that We may use any information that We obtain about You in accordance with the provisions of Our Privacy Policy. Please read Our Privacy Policy carefully as it will help You make informed decisions about sharing Your personal information with Us. 

14. License to Use Items: 

In consideration of the opportunity to participate in the Program, You grant Us an irrevocable, non-exclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for promotional / educational purposes, all or any part of the following items ("Items"): (a) all still photographs (b) all audio and video recordings in connection with the Program. You consent to the use of the Items pursuant to the foregoing in perpetuity without compensation (unless prohibited by law) or additional consents from You and waive any moral rights You may have in the Items.

15. Waiver of Liability: 

In consideration of being allowed to register for, and participate in the Program, You hereby warrant and represent that You are at least 14 years of age with parental consent or above 18 years of age and freely waive, release from liability, assume all risks, and covenant not to sue Us  or Our members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, disability, property damage, or property theft or actions of any kind that You may hereafter suffer or sustain before, during, or after the Program, unless said expense, loss, damage, personal injury, including loss of life, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of Us. This Waiver of Liability is specifically binding upon Your heirs and assigns and is knowingly given by You.

16. Force Majeure: 

In the event that it is made impossible or impracticable or illegal for Us to proceed with or carry out this Program in whole or in part, due to any natural calamity, general or specific order of government, fire, casualty, flood, earthquake, war, strike, demonstrations, lockout, pandemic, epidemic, destruction of its facilities, riot, insurrection, materials unavailability, or any other cause(s) beyond Our reasonable control,  and as a result thereof, We may delay, postpone, reschedule, terminate and/or cancel this Program, We will not be liable for any losses or damages incurred by the Participant.

17. Governing Law and Dispute Resolution: 

In the event of any dispute between the parties, the courts of Chennai, Tamil Nadu, India shall have exclusive jurisdiction on such disputes. If there is any conflict between these terms and rules and/or specific Terms & Conditions appearing on this Site relating to specific material, then the latter shall prevail. These Terms & Conditions and Your use of the Site are governed by and construed in accordance with the laws of India.

18. Limitations of Liability:

In no event will We or Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees be liable to You or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from Your use of the Site, even if We have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Our liability to You for any cause whatsoever and regardless of the form of the action will at all times be limited to the cost of the Program.  

19. Indemnification:

You agree to defend, indemnify, and hold Us harmless, including Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of Your participation in the Program and/or breach of these Terms & Conditions. 

Notwithstanding the foregoing, We reserve the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify Us, and You agree to cooperate, at Your expense, with such claims. We will use reasonable efforts to notify You of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it. 

20. Miscellaneous:

a. In view of the recent outbreak of COVID-19, the Terms & Conditions listed herein are subject to change from time to time. Any modifications to the "Terms & Conditions" will be posted on the Site and shall be notified to You through email. The modified Terms & Conditions shall also be binding upon You. 

b. The Program is subject to changes as per the directions issued by the Government and the local health authorities from time to time.

c. You agree that Your failure to adhere to any of the Terms & Conditions set out above or any other provision of these Terms & Conditions shall constitute a breach of these Terms & Conditions on Your part, which may result in the termination of Your access to the Site and/or participation in the Program.

d. If any provision or part of a provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms & Conditions and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between You and Us as a result of these Terms & Conditions or use of the Site. 

e. You agree that these Terms & Conditions will not be construed against Us by virtue of having drafted them.
