Terms & Conditions

These Terms and Conditions (“Terms & Conditions/Terms”) are legally binding between you ("You") and Shri Yogini Trust ("We" or "Us") for your registration to participate in "Naga Pratishtha” by Sadhguru (“Program”) on October 9, 2022.

You agree that by registering for this Program and accessing this website www.isha.sadhguru.org ("Site"), You have read, understood, and agreed to be bound by these Terms & Conditions. If You do not agree with all of these Terms, then You are expressly prohibited from using the Site and You must discontinue its use immediately.

You hereby represent and warrant that You are competent to enter into these Terms. You confirm that You have read, understood and agreed to these Terms. We reserve the right to revise the Terms & Conditions at any time and at Our sole discretion.

1. User Registration:

a) The minimum age limit to participate in the Program is 12 years. No one under 18 years shall register for the Program on his/her own or provide any personal information in this regard without parental consent.

b) To register for the Program, You must provide complete and accurate details/information as asked for in the registration page.

c) Your registration for the Program will be complete only after You receive an email confirming Your registration and participation. Overseas participants’ registration will be confirmed once they upload a copy of their visa.

d) The Program registration is subject to availability.

e) If You are accessing the Site from outside the territory of India, then You must be of competent age to enter into a contract as per the local laws of Your location or 18 years, whichever is higher.

2. Payment:

a) The payment must be made in full, according to the chosen category, before the commencement of the Program.

b) We accept the following mode of payments, i.e., NEFT, RTGS, Cards, Net Banking, cheques and bank demand draft.

c) In the event that the prerequisites as mentioned in these Terms & Conditions are not fulfilled, We reserve the right to cancel Your registration and the refund will be made as per the Refund and Cancellation policy provided below.

3. Refund, Cancellation, Transfer & Re-Registration Policy for "Naga Pratishtha” by Sadhguru

3.1 Refund Policy:

  1. Single participant registration - India

If a refund request is received on or before 30 September 2022, the Program fee deducted for cancellations as per the registration category is as below:

  • Padma & MahaPadma: 25% (Not applicable for overseas participants)

  • Bhujanga, Shankapala, Vasuki & Anantha: 20%

The remaining program fee refund will be processed within 30 days.

No requests for refund will be accepted after 30 September 2022, or for a no-show or for an incomplete attendance of the Program.

2. Single participant registration – Overseas

If a refund request is received on or before 30 September  2022, the Program fee deducted for cancellations as per the registration category is as below:

o   Padma & MahaPadma: Non-refundable

o   Bhujanga, Shankapala, Vasuki & Anantha: 20%

The remaining program fee refund will be processed within 30 days. 

No requests for refund will be accepted after 30 September 2022, or for a no-show or for an incomplete attendance of the Program.

3. Two-person registration in Vasuki and Ananta category - India & Overseas

If both the participants’ refund request is received on or before 30 September 2022, the Program fee deducted for cancellations from the two-person registration category is as below:

  • Vasuki and Ananta: 20%

If only one participant’s refund request is received on or before 30 September 2022, the Program fee deducted for cancellations as per the registration category is as below:

  • Vasuki: The participant retaining the registration will be transferred to Vasuki’s single participant category (for one person, the program fee is Rs. 3 lakhs) with an applicable fee of 20% deducted on the remaining amount (Rs. 2 lakhs).

  • Ananta: The participant retaining the registration will be transferred to Ananta’s single participant category (for one person the program fee is Rs. 7 lakhs) with an applicable fee of 20% deducted on the remaining amount (Rs. 5.5 lakhs).

The remaining program fee refund will be processed within 30 days.

No requests for refund will be accepted after 30 September 2022, or for a no-show or for an incomplete attendance of the Program.

4. Takshaka category

The program fee is non-refundable for anyone registered in the Takshaka category.

3.2 Transfer Policy:

Given the nature of the unique consecration event, transfer to a future program or event is not allowed.

3.3 For those who test positive for COVID-19 before the event:

If you have tested positive for COVID-19 and a refund request is received between 1 October and 9 October 2022, the cancellation fee deducted is as per the registration category:

Padma & MahaPadma: 25%

Bhujanga, Shankapala, Vasuki & Anantha: 20%

The Participant shall present a positive RT-PCR COVID test from an accredited lab before the refund can be processed.

Please Note:

All refund and cancellation requests should be sent in writing to info.iycbangalore@lingabhairavi.org from the registered email ID of the participant. No other mode of communication will be accepted.

The effective date for processing the refund will be from the formal receipt of the cancellation notification, through email in writing substantiated with supporting documents wherever needed.

The refund request will be processed within 30 days from the date of receipt of a request from the registered email ID.

In case you are not allowed to continue the program due to a violation of the code of conduct, no refund can be claimed.

4. COVID-19:

All guidelines and social distancing protocols in accordance with the notification/guidelines/orders issued by the government, local health officials and Us must be adhered to. You may be subject to a medical check-up upon arrival.

In the event You develop any COVID-19 symptoms during the Program, You agree to follow the protocols as may be prescribed by Us from time to time.

5. Medical Guidelines:

a) You shall ensure that all the information which You have provided is true and complete.

b) You must carry Your regular medications until the completion of the Program.

c) In the event of a medical condition arising during the Program, You agree to abide by the recommendations made in Your best interests by the medical team in-charge of the Program.

d) These recommendations might include taking medications, referral to a nearby hospital for further care, discontinuing the Program or leaving the Isha Yoga Center, Bengaluru.

e) You shall bear any medical expenses that You may incur during the Program.

f) If You experience any symptoms of COVID-19, You shall inform Us and follow the treatment and guidelines as prescribed by Us.

g) You must travel after taking due permissions from the concerned governmental authority to travel for the Program.

h) You should not have any symptoms of COVID-19 and should not have come in contact with people who are infected/suspected/diagnosed with COVID-19 in the past 14 days before Your travel.

i) You fully understand the risks involved due to COVID–19 and are aware of all the regulations/safety guidelines prescribed by the government. You undertake that You will strictly follow the same. You shall not hold Us responsible for Your acts of negligence in this regard and shall indemnify Isha from any liability arising out of it.

j) If You do not comply with the recommendations of the medical team, You will be requested to discontinue the Program.

6. Admission:

We reserve the right to allow admission into the venue and/cancellation of Your participation at Our sole discretion.

7. Code of Conduct:

You agree to behave in such a way as to create a safe, supportive, learning environment while at the Program. You agree not to smoke, drink alcohol or consume any hallucinogenic or banned drug. You agree not to engage in disruptive speech or behavior or otherwise interfere with the Program or other individuals’ participation in the Program. You will comply with all applicable laws and agree not to engage in any form of harassing, offensive, discriminatory or threatening speech or behavior, including relating to race, gender, sexual orientation, religion or disability. Participants engaging or threatening to engage in such behavior will be requested to leave the Program immediately, and such Participants will not be eligible to receive a refund of any fees paid towards their participation in the Program. If You witness such behavior, please promptly contact the program volunteer in order to take appropriate action.

8. Disclaimer:

The Site is provided on an as-is and as-available basis. You agree that Your use of the Site services will be at Your sole risk. To the fullest extent permitted by law, We disclaim all warranties, express or implied, in connection with the Site and Your use thereof, including, without limitation, fitness for a particular purpose and non-infringement. We make no warranties or representations about the accuracy or completeness of the Site’s content or the content of any websites linked to this Site and We will assume no liability or responsibility for any (1) errors, mistakes, or inaccuracies of content and materials, (2) personal injury or property damage, of any nature whatsoever, resulting from Your access to and use of the Site, (3) any unauthorized access to or use of Our secure servers and/or any and all personal information and/or financial information stored therein, (4) any interruption or cessation of transmission to or from the Site, (5) any bugs, viruses, trojan horses, or the like which may be transmitted to or through the Site by any third party, and/or (6) any errors or omissions in any content and materials or for any loss or damage of any kind incurred as a result of the use of any content posted, transmitted, or otherwise made available via the Site. We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Site, any hyperlinked website, or any website or mobile application featured in any banner or other advertising, and We will not be a party to or in any way be responsible for monitoring any transaction between You and any third-party providers of products or services. The terms and conditions provided in the third party website would be applicable for your transaction in those websites, Your interaction with this website does not mean that the terms of the third party website is not applicable for your transaction therein.

9. Assumption of Risk:

You acknowledge and agree that Your attendance and participation in the Program is voluntary. Since attending any of the sessions could involve the physical activity of learning Yoga, You agree to assume the risks associated with attending and participating in the Program to the fullest extent permitted under applicable law. To the extent mandated by law, You agree to indemnify Us against any and all claims, actions, losses and damages arising out of or relating to Your participation in the Program.

10. Information About You:

You consent to the collection and use of Your personal information that You provide in connection with the Program, by Us. We will use Your information to send details and announcements related to the Program to You. Any personal information that You provide to Us online will be handled in accordance with the laws and regulations of India. We are committed to protecting Your personal information and Your right to privacy. Our Privacy Policy governs the privacy policies of Our Site. You agree that We may use any information that We obtain about You in accordance with the Provisions of Our Privacy Policy. Please read Our Privacy Policy carefully as it will help You make informed decisions about sharing Your personal information with Us.

11. License to Use Items: In consideration of the opportunity to participate in the Program, You grant Us an irrevocable, non-exclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for promotional/educational purposes, all or any part of the following items ("Items"): (a) All still photographs (b) All audio and video recordings in connection with the Program. You consent to the use of the Items pursuant to the foregoing in perpetuity without compensation (unless prohibited by law) or additional consents from You and waive any moral rights You may have in the Items.

12. Waiver of Liability:

In consideration of being allowed to register for, and participate in the Program, You hereby warrant and represent that You freely waive, release from liability, assume all risks, and covenant not to sue Us or Our members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, disability, property damage, or property theft or actions of any kind that You may hereafter suffer or sustain before, during, or after the Program, unless said expense, loss, damage, personal injury, including loss of life, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of Us. This Waiver of Liability is specifically binding upon Your heirs and assigns and is knowingly given by You.

13. Force Majeure:

In the event that it is made impossible or impracticable or illegal for Us to proceed with or carry out this Program in whole or in part, due to any natural calamity, general or specific order of government, fire, casualty, flood, earthquake, war, strike, demonstrations, lockout, pandemic, epidemic, destruction of its facilities, riot, insurrection, materials unavailability, or any other cause(s) beyond Our reasonable control, and as a result thereof, We delay, postpone, reschedule, terminate and/or cancel this Program, we will not be liable for any losses or damages incurred by You.

14. Governing Law and Dispute Resolution:

In the event of any dispute between the parties, the courts of Bengaluru, Karnataka, India shall have exclusive jurisdiction on such disputes. If there is any conflict between these terms and rules and/or specific Terms & Conditions appearing on this Site relating to specific material, then the latter shall prevail. These Terms & Conditions and Your use of the Site are governed by and construed in accordance with the laws of India.

15. Limitations of Liability:

In no event will We or Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees be liable to You or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including loss of profit, loss of revenue, loss of data, or other damages arising from Your use of the Site, even if We have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Our liability to You, for any cause whatsoever and regardless of the form of the action, will at all times be limited to the cost of the Program.

16. Indemnification:

You agree to defend, indemnify, and hold Us harmless, including Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of Your participation of the Program and/or breach of these Terms & Conditions.

Notwithstanding the foregoing, We reserve the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify Us, and You agree to cooperate, at Your expense, with such claims. We will use reasonable efforts to notify You of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

17. Miscellaneous:

a) In view of the recent outbreak of the Coronavirus, the Terms & Conditions listed herein are subject to change from time to time. Any modifications to the "Terms & Conditions" will be posted on the Site and shall be notified to You through email. The modified Terms & Conditions shall also be binding upon You.

b) The Program is subject to changes as per the directions issued by the government and the local health authorities from time to time.

c) You agree that Your failure to adhere to any of the Terms & Conditions set out above, or any other provision of these Terms & Conditions, shall constitute a breach of these Terms & Conditions on Your part, which may result in the termination of Your access to the Site and/or participation in the Program.

d) If any provision or part of a provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms & Conditions and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between You and Us as a result of these Terms & Conditions or use of the Site.

18. You agree that these Terms & Conditions will not be construed against Us by virtue of having drafted them.
