Terms and Conditions

These Terms & Conditions (“Terms & Conditions”) are legally binding between you ("You") and Isha Foundation ("We" or "Us") for your child’s registration to participate in the Isha Yoga Summer Program for Children (“Program”).
You agree that by registering for this Program and accessing this website www.isha.sadhguru.org ("website"), you have read, understood, and agreed to be bound by these Terms & Conditions. If You do not agree with all of these Terms & Conditions, then You are expressly prohibited from using the website and you should discontinue your use of this website immediately.
You hereby represent and warrant that You are competent to enter into these Terms & Conditions. You confirm that You have read, understood and agreed to these Terms & Conditions. We reserve the right to revise the Terms & Conditions at any time and at our sole discretion.
1. USER REGISTRATION
a. The Program is open only for children between 9 to 12 years of age. Only the parent/guardian of the child will be able to register for the program on behalf of the child.
b. In order for Your child to participate in the Program, are required to register and create an account on the program portal. You will receive a confirmation of your account creation through the email address you provide during registration.
c. When you register for the Program, you are agreeing to: (i) provide true, accurate, current, and complete information about your child and yourself and (ii) maintain and promptly update your registration information to keep it true, accurate, current, and complete.
d. You can register for participation for your child only, i.e., You will be considered the booker who completed the booking. You shall be responsible for ensuring that your child follows the instructions given to them during the Program.
e. We have a right at our sole discretion to immediately suspend or terminate your account and refuse any and all current or future participation in the Program (or any portion thereof) if You provide any information that is untrue, inaccurate, not current, erroneous or incomplete; or We have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete;
f. You are responsible for maintaining the confidentiality of your account credentials and shall not share it with anyone.
g. Your child’s registration for the Program will be complete only after You receive an email confirming Your child’s registration and participation.
h. The Program registrations are subject to availability and we shall not be liable in case You are not able to register for the Program.
2. ACCOMMODATION AND FOOD
Stay for Your child is available in the Program hall only for the duration of the program, NOT before or after the program dates. We request you plan your travel accordingly.
Please note that stay is not available for parents as part of the Program. You can book accommodation at Isha Yoga Center at this website: cottage.isha.in or book a hotel in Coimbatore City.
Indian vegetarian meals will be provided. Please do not send any snacks and eatables, as it will not be supportive for your child’s participation in the Program.
3. CREATING A CONDUCIVE ATMOSPHERE
Participants must attend all sessions.
Ensure to wear comfortable clothes that allow free movement.
For boys: Track pants/trousers and t-shirts. Shorts are not allowed.
For girls: Salwars, pants and t-shirts. Skirts are not allowed.
Pack only dull, natural-colored clothes (avoid white, red, orange and bright colors).
4. HEALTH GUIDELINES FOR ISHA YOGA SUMMER PROGRAM
You understand that Isha Yoga Summer Program is a Program that includes physical exercises, involving muscular movements and requires a certain degree of physical fitness and agility. Sessions during the program are typically 1-1.5 hours long, with no breaks. It may cause or aggravate a physical injury, medical condition, and You represent and warrant that Your child is physically fit enough to participate in such a Program.
You agree and undertake that Your child does not have any of the following conditions:
a. History of fainting, fits, stroke, angina, heart attack, spinal problems, uncontrolled bleeding of any kind, chronic fatigue, active glaucoma, retina problems, severe nutritional deficiencies, active rheumatologic problem;
b. Major surgery in the past 6 months, minor surgery in the past 3 months.
You understand that for anyone with these conditions, this Program is contraindicated and can be harmful to the health of such a person. You understand that even if Your child has other conditions apart from those listed, it is Your responsibility to consult a healthcare provider and certify Your child to be fit enough for the Program prior to enrolling in this Program. If You have done so, You represent and warrant that You are following Your healthcare provider’s advice.
If Your child has an acute or aggravated mental health condition, then You understand that You must consult with a professional mental healthcare provider before registering Your child to participate in the Program, and You represent and warrant that You have done so and are following Your healthcare provider’s advice.
In consideration for being permitted to participate in the Program, You agree to assume full responsibility for any risks, injuries, or damages, known or unknown, that Your child might incur as a result of participating in the Program.
In further consideration for being permitted to participate in the Program, You hereby knowingly, voluntarily, and expressly waive any and all claims, liabilities, demands, expenses, fees, legal actions, rights of action for damages, personal injury, mental suffering and distress, or death (“Claims”), including legal fees or expenses, that You may suffer or that Your spouse, parents, children, or unborn children may suffer in connection with Your child participation in the Program. You agree to indemnify, release, and hold harmless Isha Foundation, including its trustees, representatives, teachers, instructors, co-instructors, presenters, facilitators, employees, agents, volunteers, and independent contractors (collectively, the “Indemnified Parties”), from and against any loss, cost, or liability incurred in defending any Claim made by You or anyone making a Claim on Your behalf, even if the Claim is alleged to or did result from the negligence of any of the Indemnified Parties or anyone else.
To the full extent permitted by law, You and Your legal heirs or legal representatives forever release, waive, discharge, and covenant not to sue any of the Indemnified Parties for any Claim caused by any negligence or other acts of the Indemnified Parties.
Isha Foundation maintains the right to accept or reject any registration on medical grounds.
5. SAFETY GUIDELINES
In case of any medical history of Your child, please mention it in the registration form and consult with the teacher before beginning the class.
We may in our sole discretion prohibit Your child from participating in the Program if we feel that Your child’s health situation is not conducive for attending the Program.
Injuries or Benefits:
We exclude all representations, warranties, undertakings and guarantees relating to Our Program. We do not represent, warrant, undertake or guarantee:
a. that Your child will not suffer from any injury arising directly or indirectly from our Program;
b. that Your child’s fitness will measurably improve as a result of participation in the Program.
6. PAYMENT
The payment must be made in full before the commencement of the Program.
We accept the following mode of payments, i.e., debit/credit cards, Net Banking, e-wallets & UPI.
In the event the prerequisites mentioned in these Terms & Conditions are not fulfilled, We reserve the right to cancel Your child’s registration and the refund will be done as per the cancellation and refund policy provided below.
If you have already attempted a payment but your registration has not been updated, please wait at least 24 hours before retrying. This ensures the transaction has enough time to process and reflect in the booking system, helping to avoid accidental duplicate payments.
Payments made under different registration IDs, even if for the same booker/participant, will not be considered duplicate payments. These will be treated as separate and intentional registration made by the booker/participant.
A payment will be considered a duplicate or double payment only when the same booking ID is charged more than once.
7. CANCELLATION AND REFUND POLICY
Cancellation & Refund:
80% of the Program Fee will be processed as refund for valid cancellation request received up to 3 days before the start date of Program. No refund requests shall be eligible thereafter. The person who completed the booking must contact support.ishafoundation.org within the time frame mentioned in these Terms to request for a refund.
Refund request requires PDF copies of your Payment Receipt and a duly filled and signed Refund Request Form to be sent within seven days of filing your cancellation request or at least three days before the program start date, whichever is earlier.
For online payments, the refund will be made by the same mode of payment, i.e., via credit/debit card or bank account transfer, and the funds will be credited to the respective credit/debit card or bank account. Refunds made for offline payments like cash will be made only through NEFT into Indian bank accounts only.
The refund will be processed within 30 days, provided that all the required documents are in order.
There will be no refund for a no-show.
If you leave the Program for any reason, you will not be eligible for a refund and we will consider this as a cancellation of your registration.
Refunds are not possible for re-registered programs.
Re-Registration Policy:
a. It may be possible to re-register for the same program at a later date if you are unable to attend the Program you are registering for. A 15% re-registration fee is applicable.
b. Re-registration will only be allowed when the same is applied from the registered email id used for the originally registered Program
c. If your child age is coming under Program eligibility criteria at the time of Program re-registration, you can register him/her for the same class/program within 1 Year of the originally registered Program start date. If the Program fee has increased, you will have to pay the difference in fee in addition to the re-registration fee.
d. Re-registration will also not be applicable if the Program is not scheduled within 1 year of the date of start of the Program You originally registered for.
e.If the children's age is not coming under program eligibility criteria, one of the parents can re-register for any Program conducted by Isha Foundation at Isha Yoga Center Coimbatore within 6 months of the originally registered program start date. Please note this cannot be used for any Isha Health Solutions program and a 15% re-registration fee is applicable.
f. No cancellation or refund requests will be accepted beyond the terms and conditions stated herein. Requests to transfer an existing registration to another program may be considered on a case-by-case basis, at our sole discretion. However, approval of such requests is not guaranteed.
8. ADMISSION
We reserve the right to allow admission into the Program and/cancellation of Your participation at Our sole discretion.
9. TERMS OF USE FOR THE WEBSITE
By accessing this website you are agreeing to the terms of this Terms & Conditions as they appear and are legally bound by them, whether or not you have read them. If at any time you do not agree with these Terms & Conditions, please cease visiting our website and do not use our Programs, Classes and Services.
These Terms & Conditions are subject to changes and/or updates, and we are not bound to provide notice of such changes or updates. We reserve the right to make changes or updates at any time and hereby inform all Visitors that the burden is on the Visitor to check the Terms & Conditions for updates from time to time. By continuing to use the website and the content we produce, you agree to be bound by the most updated version of the Terms & Conditions, whether or not you have read it.
10. VOLUNTARY PARTICIPATION
You acknowledge that participation in our Classes, Programs, Services and Program Materials and visiting our website is done voluntarily and that you alone are 100% solely and personally responsible for You and your child’s participation in our website, Products, Classes Programs, Services and Program Materials and for any outcomes or results that result therefrom (whether positive or negative). You acknowledge that you have or will use your own due diligence and judgment before implementing any knowledge or information you received from our website, Products, Classes, Programs, Services or Program Materials. Isha Foundation is not responsible for any action you may choose to take regarding the information provided, and you acknowledge and agree that we are not responsible nor liable to you should You and Your child sustain any financial harm, physical injuries or any negative ramifications. You acknowledge that the information contained on this website is intended as general information only and you agree that any decisions you make to implement or follow anything you find on the website are wholly your own.
If you child fails to abide by the instructions given during the course of the Program, including but not limited to adhering to timings, personal conduct, etc. the child shall be asked to leave the Program. No refund shall be issued if the child is asked to leave in such event.
Due to the nature of the Program, the child must attend every session through the course of the entire Program. You accept that failure to attend any single session will disqualify the child to continue with the Program. You further accept that failure by the Child to reach on time for a session will be deemed as failure to attend and he/she will not be permitted to enter the session. No refund shall be issued in case of failure to attend irrespective of number of sessions attended.
11. CODE OF CONDUCT
You agree to behave in such a way as to create a safe, supportive, learning environment while your child is participating in the Program. You shall comply with the following:
Dress Code - Both men and women should wear clothing that covers shoulders, upper arms, midriff, and legs down to their ankles. Tight or transparent clothing should not be worn.
Behaviour - You are expected to uphold the sanctity, serenity, and safety of the Venue through respectful and lawful conduct at all times. You are required to comply with all applicable laws and adhere to a strict code of ethical and personal behavior. Any act of assault, harassment (including verbal, physical, emotional, or sexual), child abuse, sexual misconduct, stalking, exploitation, or any other form of unlawful, unsafe, or disruptive behavior is strictly prohibited. Discriminatory or offensive speech or conduct—whether explicit or implied—based on race, caste, gender, sexual orientation, religion, nationality, age, or disability will not be tolerated under any circumstances.
Consumption - You agree not to smoke, drink alcohol or consume any hallucinogenic or banned drug at the Venue premises.
Consequences - Participants engaging or threatening to engage in such behavior will be asked to leave the Program immediately, and such Participants will not be eligible to receive a refund of any fees paid towards their participation in the Program.
If You witness such behavior mentioned above, please promptly contact the Program Volunteers in order to take appropriate action. We reserve the right to initiate legal action or follow the due process of law if You violate the code of conduct or any laws.
12. ASSUMPTION OF RISK
You acknowledge and agree that Your child’s attendance and participation in the Program is voluntary. You agree to assume the risks associated with Your child’s attending and participating in the Program to the fullest extent permitted under applicable law. To the extent permissible by law, You agree to indemnify Us against any and all claims, actions, losses and damages arising out of or relating to Your child’s participation in the Program.
13. INFORMATION ABOUT YOU
You consent to the collection and use of Your child’s personal information that You provide in connection with the Program, by Us. We will use Your child’s information to send details and announcements related to the Program to You. Any personal information that You provide to Us online will be handled in accordance with the laws and regulations of India. We are committed to protecting Your personal information and Your right to privacy. Our Privacy Policy governs the privacy policies of Our website. You agree that We may use any information that We obtain about You in accordance with the provisions of Our Privacy Policy. Please read Our Privacy Policy carefully as it will help You make informed decisions about sharing Your personal information with Us.
14. INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, the website is Our proprietary property and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the website (collectively, the “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned by Isha, and are protected by copyright and trademark laws and various other intellectual property rights.
The Content and the Marks are provided on the website “as-is” for Your information and personal use only. Except as expressly provided in these Terms & Conditions, no part of the website and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, screen-shotted, photographed, screen-recorded, encoded, translated, transmitted, distributed, downloaded, edited, broadcasted, transferred, taught, used, sold, licensed, or otherwise exploited for any commercial or non-commercial purpose whatsoever, without Our express prior written permission.
Provided that You are eligible to use the website, You are granted a limited license to access and use the website to which You have properly gained access solely for Your child’s participation in the Program. We reserve all rights not expressly granted to You in and to the website, the Content and the Marks.
15. PROHIBITED ACTIVITIES WHILE USING THE WEBSITE
You may not access or use the website for any purpose other than that for which We make the website available. The website may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by Us.
As a user of the website, You agree not to:
a. systematically retrieve data or other content from the website to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from Us.
b. make any unauthorized use of the website, including collecting usernames and/or e-mail addresses of users by electronic or other means for the purpose of sending unsolicited emails, or creating user accounts by automated means or under false pretenses.
c. circumvent, disable, or otherwise interfere with security-related features of the website, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the website and/or the Content contained therein.

16. WEBSITE MANAGEMENT
We reserve the right, but not the obligation, to:
a. monitor the website for violations of these Terms & Conditions;
b. take appropriate legal action against anyone who, in Our sole discretion, violates the law or these Terms & Conditions, including without limitation, reporting such user to law enforcement authorities;
c. in Our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of Your Contributions or any portion thereof;
d. in Our sole discretion and without limitation, notice, or liability, to remove from the website or otherwise disable all files and content that are excessive in size or are in any way burdensome to Our systems;
e. otherwise manage the website in a manner designed to protect Our rights and property and to facilitate the proper functioning of the website. In addition to terminating or suspending Your account, We reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
We cannot guarantee the website will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the website, resulting in interruptions, delays, or errors. We reserve the right to change, revise, update, suspend, discontinue, or otherwise modify the website at any time or for any reason without notice to You.
You agree that We have no liability whatsoever for any loss, damage, or inconvenience caused by Your inability to access or use the website during any downtime or discontinuance of the website. Nothing in these Terms & Conditions will be construed to obligate Us to maintain and support the website or to supply any corrections, updates, or releases in connection therewith.

18. LICENSE TO USE ITEMS
In consideration of the opportunity for Your child to participate in the Program, You grant Us an irrevocable, non-exclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for promotional/educational purposes, all or any part of the following items ("Items"): (a) all still photographs (b) all audio and video recordings in connection with the Program. You consent to the use of the Items pursuant to the foregoing in perpetuity without compensation (unless prohibited by law) or additional consents from You and waive any moral rights You and Your child may have in the Items
19. WAIVER OF LIABILITY
In consideration of Your child being allowed to register for, and participate in the Program, You hereby warrant and represent that You are the rightful parent/guardian of the child and freely waive, release from liability, assume all risks, and covenant not to sue Us or Our members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, disability, property damage, or property theft or actions of any kind that You and Your child may hereafter suffer or sustain before, during, or after the Program, unless said expense, loss, damage, personal injury, including loss of life, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of Us. This Waiver of Liability is specifically binding upon Your heirs and assigns and is knowingly given by You.
20. FORCE MAJEURE
In the event that it is made impossible or impracticable or illegal to proceed with or carry out this Program in whole or in part, due to any natural calamity, general or specific order of government, fire, casualty, flood, earthquake, war, strike, demonstrations, lockout, pandemic, epidemic, destruction of its facilities, riot, insurrection, power disruption, technical difficulties, internet connectivity, materials unavailability, or any other cause(s) beyond reasonable control and as a result thereof, there may be delay, postponement, rescheduling, termination and/or cancellation of this Program, and We will not be liable for any losses or damages incurred by You.
21. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement shall be governed by and construed in accordance with the laws of India, without regard to its conflicts of law principles. Disputes shall be resolved via online arbitration under https://cnica-odr.com/ and its Rules. Notices and other communication to be served/provided electronically. Arbitration venue shall be in Chennai, language in English, under Arbitration and Conciliation Act, 1996. Courts at Coimbatore shall have exclusive jurisdiction.
22. LIMITATIONS OF LIABILITY
In no event will We or Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees be liable to You or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from Your use of the website, even if We have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Our liability to You for any cause whatsoever and regardless of the form of the action, will at all times be limited to the cost of the Program.
23. INDEMNIFICATION
You agree to defend, indemnify, and hold Us harmless, including Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of Your child’s participation in the Program and/or breach of these Terms & Conditions.
Notwithstanding the foregoing, We reserve the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify Us, and You agree to cooperate, at Your expense, with such claims. We will use reasonable efforts to notify You of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
24. MISCELLANEOUS
Any modifications to the Terms & Conditions will be posted on this website. The modified Terms & Conditions shall also be binding upon You.
You agree that Your failure to adhere to any of the Terms & Conditions set out above, or any other provision of these Terms & Conditions, shall constitute a breach of these Terms & Conditions on Your part which may result in the termination of Your access to this website and/or participation in the program.
If any provision or part of a provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms & Conditions and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between You and Us as a result of these Terms & Conditions or use of the website.
