These Terms and Conditions (“Terms & Conditions/Terms”) are legally binding between you ("You") and Then Kailaya Bakthi Peravai ("We" or "Us") for your registration to participate in “Yogeshwara Maha Abhishekam” (“Program”).
You agree that by registering for this Program and accessing the website www.isha.sadhguru.org ("Site"), You have read, understood, and agreed to be bound by these Terms & Conditions. If You do not agree with all of these Terms, then You are expressly prohibited from using the Site and you must discontinue use immediately.
You hereby represent and warrant that You are competent to enter into these Terms. You confirm that You have read, understood and agreed to these Terms. We reserve the right to revise the Terms & Conditions at any time and at Our sole discretion.
1. USER REGISTRATION:
(i) The minimum age limit to participate in the Program is 14 years. But no one under 18 years shall register for the Program on his/her own or provide any personal information in this regard without parental consent.
(ii) This Program is only available for Indian participants and only Indian mode of payments will be accepted.
(iii) To register for the Program, You must provide complete and accurate details/information as asked for in the registration page.
(iv) Your registration for the Program will be complete only after You receive a confirmation e-mail, confirming Your registration and participation.
(v) The Program registrations are subject to availability.
(vi) You may participate in the Program through the online livestream for MahaShivaRatri. The link will be shared with You along with the confirmation.
(vii) For the purposes of registration, You shall be considered the booker.

To participate in the Program it will be mandatory for You to have compatible hardware, such as:
● laptop/desktop computer/mobile device.
● stable internet access with sufficient bandwidth (2mbps)/ adequate data pack. A Wi-Fi or wired internet connection is recommended.
It is best to connect through a laptop or desktop computer and to keep Your phone switched off. Please ensure that the device You use for the Program is kept on charge for the entire duration of the Program. It is recommended not to use tablets and smartphones as the Program video may not support these devices.
Software requirement:
Google Chrome version 85 or later is recommended.
Please ensure that all Your hardware and software are fully functional, prior to the start of the Program.
We will not be responsible for any equipment or network malfunctions or service disruptions from Your end that may affect Your session.
Note: You are expressly prohibited from photographing, screen-shotting, screen-recording and/or recording, by video or audio, any part of the Program for any purpose whatsoever. Please go through Our Intellectual Property Rights section.
3. PAYMENT:
a. Making donations for the Program is not mandatory. However, You may donate any amount as per your wish.
b. We accept the following modes of donation, i.e., Debit Cards, Credit Cards, Net Banking, e-Wallets and UPI.
c. Donations made will not be refunded under any circumstances.
4. INFORMATION ABOUT YOU
You consent to the collection and use of Your personal information that You provide in connection with the Program, by Us. We will use Your information to send details and announcements related to the Program to You. Any personal information that You provide to Us online will be handled in accordance with the laws and regulations of India. (xx) except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the Site, or uses or launches any unauthorized script or other software.
(xxi) disparage, tarnish, or otherwise harm, in Our opinion, Us and/or the Site.
(xxii) use the Site in a manner inconsistent with any applicable laws or regulations.
7. SITE MANAGEMENT:
We reserve the right, but not the obligation, to:

In consideration of the opportunity to participate in the Program, You grant Us an irrevocable, non-exclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for promotional/educational purposes, all or any part of the following items ("Items"): (a) all still photographs (b) all audio and video recordings in connection with the Program. You consent to the use of the Items pursuant to the foregoing in perpetuity without compensation (unless prohibited by law) or additional consents from You and waive any moral rights You may have in the Items.
10. WAIVER OF LIABILITY:
In consideration of being allowed to register for, and participate in the Program, You hereby warrant and represent that You are at least 14 years of age with parental consent or above 18 years of age and freely waive, release from liability, assume all risks, and covenant not to sue Us or Our members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, disability, property damage, or property theft or actions of any kind that You may hereafter suffer or sustain before, during, or after the Program, unless said expense, loss, damage, personal injury, including loss of life, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of Us. This Waiver of Liability is specifically binding upon Your heirs and assigns and is knowingly given by You.
11. FORCE MAJEURE:
In the event that it is made impossible or impracticable or illegal to proceed with or carry out this Program in whole or in part, due to any natural calamity, general or specific order of government, fire, casualty, flood, earthquake, war, strike, demonstrations, lockout, pandemic, epidemic, destruction of its facilities, riot, insurrection, power disruption, technical difficulties, internet connectivity, materials unavailability, or any other cause(s) beyond reasonable control and as a result thereof, there may be delay, postponement, rescheduling, termination and/or cancellation of this Program, and We will not be liable for any losses or damages incurred by the You.
12. GOVERNING LAW AND DISPUTE RESOLUTION:
Disputes shall be resolved via online arbitration under https://cnica-odr.com/ and its Rules. Notices and other communication to be served/provided electronically. Arbitration venue shall be in Chennai, language in English, under Arbitration and Conciliation Act, 1996. Courts at Coimbatore shall have exclusive jurisdiction.
13. LIMITATIONS OF LIABILITY:
In no event will We or Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees be liable to You or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from Your use of the Site, even if We have been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, Our liability to You for any cause whatsoever and regardless of the form of the action, will at all times be limited to the cost of the Program.
14. INDEMNIFICATION:
You agree to defend, indemnify, and hold Us harmless, including Our subsidiaries, affiliates, and all of Our respective officers, volunteers, agents, partners, teachers, trustees, founder and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of Your participation of the Program and/or breach of these Terms & Conditions.
Notwithstanding the foregoing, We reserve the right, at Your expense, to assume the exclusive defense and control of any matter for which You are required to indemnify Us, and You agree to cooperate, at Your expense, with such claims. We will use reasonable efforts to notify You of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.
15. MISCELLANEOUS:
(i) Any modifications to the Terms & Conditions will be posted on this Site and shall be notified to You through e-mail. The modified Terms & Conditions shall also be binding upon You.
(ii) You agree that Your failure to adhere to any of the Terms & Conditions set out above, or any other provision of these Terms & Conditions, shall constitute a breach of these Terms & Conditions on Your part which may result in the termination of Your access to this Site and/or participation in the program.
(iii) If any provision or part of a provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms & Conditions and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between You and Us as a result of these Terms & Conditions or use of the Site.

You hereby represent and warrant that You are competent to enter into these Terms. You confirm that You have read, understood and agreed to these Terms. We reserve the right to revise the Terms & Conditions at any time and at our sole discretion.
1. User Registration:
1.1 The minimum age limit to participate in the Event is 10 years. All participants under the age of 18 must be accompanied by their parent / legal guardian.
1.2. For participants under 18 years of age, parent / legal guardian must fill & sign the consent form before completing the registration.
1.3 You can register for participation for yourself only, i.e., You will be considered the booker who completed the booking. In case the participant is a different person from the booker, the Terms and Conditions need to be accepted by the participant prior to participation in the Event, and the booker will ensure this.
1.4 In order to participate in the Event, you may be required to register and create an account on the program portal. You will receive a confirmation of your account’s creation through the email address you provide during registration.
1.5 Your registration for the Event will be complete only after You receive an email confirming Your registration and participation. Without receiving the same, you will not be permitted to attend the Event.
1.6 The Event registrations are subject to availability.
1.7 Please note that the check-in counters at the venue will be open from 10:00 AM. We request you to plan your travel accordingly as we will not be able to accommodate check-ins outside these timings.
1.8 Please stay back for the event until 6:00 AM on the next day of the scheduled event start date.
2. Payment
2.1 The payment must be made in full, according to the chosen category, at the time of registration.
2.2 We accept the following modes of payment, i.e., Credit/Debit Cards, Net Banking, e-Wallets and UPI.
2.3 In the event of non-compliance and non-fulfillment of any prerequisites mentioned in these Terms & Conditions, We reserve the right to cancel Your registration and the refund will be processed as per the cancellation and refund policy provided below.
3. Refund Policy:
All requests for cancellation and refunds must be submitted by the person who completed the booking, in accordance with the following terms:
a. If a refund request is received 15 days or more prior to the scheduled Event start date, 20% of the Program Fee shall be deducted, and the balance shall be refunded.
b. No refund shall be granted for requests received within 15 days prior to the scheduled Event start date, or in cases of no-show or incomplete attendance of the Event.
c. Please Note:
i) All cancellation requests should be sent in writing to registration.support@mahashivarathri.org
No other mode of communication for refund requests will be accepted.
ii) In case You are not allowed to participate in the Event due to any other reasons or breach of code of conduct, no refund can be claimed.
iii) The refund request will be processed within 30 days from the date of the request.
iv) The request for refund or transfer must be sent from Your registered email ID. The effective date for processing the refund will be from the formal receipt of the cancellation notification, in writing with supporting documents where applicable.
4. Transfer:
a. You have the option of transferring Your registration for the Event to a family member, relative or friend anytime on or 15 days prior to the scheduled event start date by writing to registration.support@mahashivarathri.org. No transfers will be allowed after 15 days before the scheduled event start date. No other mode of communication for transfer requests will be accepted.
b. The transferee shall complete the registration process online and the application will be processed and reviewed as per the standard procedure before confirming the registration.
c. The terms of transfer are applicable only for this Event and they cannot be transferred to any other program.
5. Accommodation
No accommodation will be provided as part of this Event.
6. Medical Guidelines
6.1 You shall ensure that all the information provided is true and complete.
6.2 You must carry Your regular medications while attending the Event.
6.3 In the event of a medical condition arising during the Event, You agree to abide by the recommendations made in Your best interests by the medical team in charge of the Event.
6.4 This might include taking medications, referral to a nearby hospital for further care, discontinuing the Event or leaving the Event venue.
6.5 If You experience any symptoms of a medical condition, You shall inform Us and must leave the Event immediately.
6.6 You fully understand the risks involved due to infectious diseases and are aware of all the regulations/safety guidelines prescribed by the Government. You undertake that You will strictly follow the same. You shall not hold Us responsible for Your acts of negligence in this regard and shall indemnify Us from any liability arising out of it.
6.7 If You do not comply with the recommendations of the medical team, You will be requested to discontinue the Event.
7. Admission:
We reserve the right to allow admission into the Event venue and cancel Your participation at Our sole discretion.
8. Code of Conduct:
You agree to behave in such a way as to create a safe and supportive environment while at the Event venue. You shall comply with the following:
Dress Code - Both men and women should wear clothing that covers shoulders, upper arms, midriff, and legs down to their ankles. Tight or transparent clothing should not be worn.
Behaviour - You shall uphold the sanctity, serenity, and safety of the Venue through respectful and lawful conduct at all times. You shall comply with all applicable laws and adhere to a strict code of ethical and personal behavior. Any act of assault, harassment (including verbal, physical, emotional, or sexual), child abuse, sexual misconduct, stalking, exploitation, or any other form of unlawful, unsafe, or disruptive behavior is strictly prohibited. Discriminatory or offensive speech or conduct—whether explicit or implied—based on race, caste, gender, sexual orientation, religion, nationality, age, or disability will not be tolerated under any circumstances. If You are found violating any of the above, we reserve the right to take legal action against You.
Consumption - The consumption or use of the following is strictly prohibited and shall not smoke, drink alcohol or consume any hallucinogenic or banned drug at the Venue premises.
Consequences - Participants engaging or threatening to engage in such behavior will be asked to leave the Event immediately, and such Participants will not be eligible to receive a refund of any fees paid towards their participation in the Event. We reserve the right to initiate legal action or follow the due process of law if You violate the code of conduct or any laws. If You witness such behavior mentioned above, please promptly contact the Event Volunteers in order to take appropriate action.
9. Assumption of Risk:
9.1 You acknowledge and agree that Your attendance and participation in the Event is voluntary. You agree to assume the risks associated with attending and participating in the Event to the fullest extent permitted under applicable law.
9.2 To the extent permissible by law, You agree to indemnify Us against any and all claims, actions, losses and damages arising out of or relating to Your participation in the Event.

13. Force Majeure:

17.2 The Event is subject to changes as per the directions issued by the Government and the local health authorities from time to time.
