These Terms and Conditions (“Terms & Conditions/Terms”) are legally binding between you ("You") and Thenkailaya Bakthi Peravai ("We" or "Us") for your registration to donate and to receive “Rudraksha Diksha”. Kindly read the following terms and conditions carefully, as these terms constitute an agreement between You and Then Kailaya Bakthi Peravai. By registering for Rudraksha Diksha, You agree to be bound by these terms and conditions. It is Your responsibility to have read these terms and conditions before registration.
You hereby represent and warrant that You are competent to enter into these Terms. You confirm that You have read, understood and agreed to these Terms. We reserve the right to revise the Terms & Conditions at any time and at our sole discretion.
1. User Registration:
a. Anyone can register for ‘‘Rudraksha Diksha’’. But no one under 18 years shall register on his/ her own and/ or provide any personal information without parental consent.
b. To register for “Rudraksha Diksha”, You must provide true, complete and accurate details/ information as asked for in the registration page.
c. Your registration for “Rudraksha Diksha” will be complete only after You receive an SMS/ WhatsApp message/email confirming Your registration.
d. Dispatch of Rudraksha Diksha packages will start only after Mahashivratri, i.e., Friday, March 8th, 2024.
e. We will not be delivering “Rudraksha Diksha” outside India. If you need the “Rudraksha Diksha” outside India, then you can contact the local Isha Center.
f. You can register for a maximum of 2 “Rudraksha Diksha” from one mobile number. It is recommended that only one Rudraksha is worn by a person.
2. Donation:
a. Making donations for receiving Rudraksha Diksha is not mandatory. However, You may donate any amount as per your wish since we will be distributing millions of Rudraksha, which would require an enormous amount of manpower and money.
b. If you wish, you may donate for your Rudraksha as well as for others.
c. The Rudraksha Diksha package will contain Rudraksha, Abhaya Sutra, Vibhuti, an Adiyogi Image and a Pamphlet stating how to use each of these offerings. Please read it carefully before wearing the Rudraksha.
d. We accept the following modes of donation, i.e., Debit Cards, Credit Cards, Net Banking, e-Wallets and UPI.
e. Donations made will not be refunded under any circumstances.
3. “Rudraksha Diksha” Participation Aspects:
a. Owing to the fact that Rudraksha is a natural product, please note the following:
i)The appearance and the description of the “Rudraksha Diksha” given on the website and the actual product delivered may be at variance.
ii) The size and shape of the Rudraksha can differ between each individual piece.
b. Depending on a person’s body constitution and health, there may be some allergic reactions caused by tying of the sutra. If some such reaction happens, you can choose to discontinue wearing it.
c. We may contact the participants in future to provide information and support for any online sessions in relation to Rudraksha Diksha that may be conducted for them through SMS/WhatsApp/email.
4. Shipping and Delivery:
a. Rudraksha Diksha is offered during Mahashivratri to millions of devotees. It may take a few months to ship your package, considering the large volumes and restrictions that may apply due to any possible Force Majure event (please read clause no. 7). We seek your cooperation and understanding regarding the same.
b. Please note that shipping will take place through India Post.
c. If the package sent to You is returned to us due to wrong address or the addressee not being available or for any other reason, you will need to re - register again for the following year, if and once the program is launched. d. Though maximum care will be taken to ensure proper delivery of the consignment, there may be cases of damage to the consignment in transit or missing products. In case of any damage to the consignment or missing product, you may reach out to us by email at rudrakshadiksha.support@mahashivarathri.org. Replacement will be provided at Our sole discretion.
5. Privacy:
a. In case any donation is made by you for the Rudraksha Diksha, then the payment details provided by You shall be utilized only for the purpose of receiving the donation to be made by You to Us. In order to securely provide Our Services, we use trusted Payment Gateway Service Providers (currently CCAvenue® & HDFC Bank Ltd., but may be subject to change from time to time). We do not store Your banking information with Us, therefore You understand that the Payment Gateway Service Providers have their own privacy policies and terms and conditions in respect to the information You provide for donation. We recommend that You read their privacy policies and terms and conditions so You can understand the manner in which Your personal information and Your banking details will be handled by these service providers here on.
b. Similarly, please review the Privacy Policies and Terms and Conditions of Our Courier service providers to understand the way in which Your personal information will be handled by these service providers.
c. Please review Our Privacy Policy which also governs Your registration, to understand Our practices. The personal information/data provided to Us by You during the registration will be treated as strictly confidential and in accordance with Our Privacy Policy and applicable laws and regulations of India. If You object to Your information being transferred or used, please do not proceed for the registration.

6. Assumption of Risk:
You agree to indemnify Us against any and all claims, actions, losses and damages arising out of or relating to Your registration for the “Rudraksha Diksha”, receipt of the “Rudraksha Diksha” package and any consequence arising out of following the instructions related to the use of the offerings in the “Rudraksha Diksha” package or following the optional sadhana instructions which may be available on the Site or sent to you via email.
7. Force Majeure:
In the event that it is made impossible or impractical or illegal for Us to proceed with or carry out “Rudraksha Diksha” in whole or in part, due to any natural calamity, general or specific order of government, fire, casualty, flood, earthquake, war, strike, demonstrations, lockout, pandemic, epidemic, destruction of facilities, riot, insurrection, materials unavailability, or any other cause(s) beyond Our reasonable control, as a result thereof, We may delay, postpone, reschedule, terminate and/or cancel “Rudraksha Diksha”, and will not be liable for any losses or damages incurred by You.
8. Governing Law and Dispute Resolution:
In the event of any dispute between the parties, the courts of Chennai, Tamil Nadu, India shall have exclusive jurisdiction on such disputes. If there is any conflict between these terms and rules and/or specific Terms & Conditions appearing on the Site relating to specific issues, then the latter shall prevail. These Terms & Conditions and Your use of the Site are governed by and construed in accordance with the laws of India.
9. Miscellaneous:
a. You understand that your registration will be done through Single Sign On, a service provided by Isha Life Private Limited (ILPL). Hence, it is pertinent that You have read and understood and agree to the Terms of Use [https://ishalogin.sadhguru.org/tnc.php] and Privacy Policy [https://ishalogin.sadhguru.org/privacy-policy.php] of the Single Sign On platform for the purpose of your registration. This Terms and Condition and the Terms of Use of Single Sign On shall be read together for your registration of this Program.
b. The Terms & Conditions listed herein are subject to change from time to time. Any modifications to the "Terms & Conditions" will be posted on the Site. The modified Terms & Conditions shall also be binding upon You.
c. The “Rudraksha Diksha” is subject to changes as per the directions issued by the Government and the local health authorities from time to time.
d. You agree that Your failure to adhere to any of the Terms & Conditions set out above, or any other provision of these Terms & Conditions, shall constitute a breach of these Terms & Conditions on Your part, which may result in the termination of Your access to the Site and/or registration for “Rudraksha Diksha”.
e. If any provision or part of a provision of these Terms & Conditions is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms & Conditions and does not affect the validity and enforceability of any remaining provisions.

These Terms and Conditions (“Terms & Conditions/Terms”) are legally binding between you ("You") and Then Kailaya Bakthi Peravai ("We" or "Us") for your registration to participate in person in “Isha Mahashivratri” (“Event”).
By registering for this Event and accessing this website - mahashivarathri.org ("Site"), You confirm that You have read, understood, and agreed to be bound by these Terms & Conditions. If You do not agree with all of these Terms, then You are expressly prohibited from using the Site and you must discontinue the use immediately.
You hereby represent and warrant that You are competent to enter into these Terms. You confirm that You have read, understood and agreed to these Terms. We reserve the right to revise the Terms & Conditions at any time and at our sole discretion.
1. User Registration:
1.1 The minimum age limit to participate in the Event is 10 years. But no one under 18 years shall register for the Event on his/her own accord or provide any personal information in this regard without parental consent.
1.2 To register for the Event, You must provide complete and accurate details/information as asked for in the registration page.
1.3 Your registration for the Event will be complete only after You receive an email confirming Your registration and participation. Without receiving the same, you will not be permitted to attend the Event.
1.4 The Event registrations are subject to availability.
1.5 Please note that the check-in counters at the venue will be open from 10:00 AM. We request you to plan your travel accordingly as we will not be able to accommodate check-ins outside these timings.
1.6 Please stay back for the event until 6:00 AM on 27th February, 2025. Due to security reasons, You will not be allowed to leave the venue once checked-in.
2. Payment
2.1 The payment must be made in full, according to the chosen category, at the time of registration.
2.2 We accept the following modes of payment, i.e., Credit/Debit Cards, Net Banking, e-Wallets and UPI.
2.3 In the event of non-compliance and non-fulfillment of any prerequisites mentioned in these Terms & Conditions, We reserve the right to cancel Your registration and the refund will be processed as per the cancellation and refund policy provided below.
3. Refund Policy:
a. If a cancellation refund request is received by 5 February 2025, 50% of the Program fee will be deducted for cancellation.
b. No requests for refund will be accepted on or after 5 February 2025, or for a no-show, or for an incomplete attendance of the Program.
d. Please Note:
i) All cancellation requests should be sent in writing to registration.support@mahashivarathri.org , No other mode of communication for refund requests will be accepted.
ii) In case You are not allowed to participate in the program due to any other reasons or model code of conduct, no refund can be claimed.
iii) The refund request will be processed within 30 days from the date of the request.
iv) The request for refund or transfer must be sent from Your registered email ID.The effective date for processing the refund will be from the formal receipt of the cancellation notification, in writing with supporting documents where applicable.
4. Transfer:
a. You have the option of transferring Your registration for the Program to a family member, relative or friend anytime on or before 5 February 2025 by writing to registration.support@mahashivarathri.org. No other mode of communication for transfer requests will be accepted.
b. The transferee shall complete the registration process online and the application will be processed and reviewed as per the standard procedure before confirming the registration.
c. The terms of transfer are applicable only for this Program and they cannot be transferred to any other program.
d. No transfers will be allowed after 5 February 2025.
5. COVID-19 Protocols
5.1 All guidelines and social distancing protocols in accordance with the notification/guidelines/orders issued by the government, local health officials and Us must be adhered to. You may be subject to medical checkups upon arrival and during the Event.
5.2. In the event You develop any COVID-19 symptoms during the Event, Your participation in the Event will be terminated immediately.
6. Accommodation
No accommodation will be provided as part of this Event.
7. Medical Guidelines
7.1 You shall ensure that all the information provided is true and complete.
7.2 You must carry Your regular medications while attending the Event.
7.3 In the event of a medical condition arising during the Event, You agree to abide by the recommendations made in Your best interests by the medical team in charge of the Event.
7.4 This might include taking medications, referral to a nearby hospital for further care, discontinuing the Event or leaving the Event venue.
7.5 If You experience any symptoms of COVID-19, You shall inform Us and must leave the Event immediately.
7.6 You must travel after taking due permissions from the concerned governmental authority to attend the Event.
7.7 You fully understand the risks involved due to COVID–19 and are aware of all the regulations/safety guidelines prescribed by the Government. You undertake that You will strictly follow the same. You shall not hold Us responsible for Your acts of negligence in this regard and shall indemnify Us from any liability arising out of it.
7.8 If You do not comply with the recommendations of the medical team, You will be requested to discontinue the Event.
8. Admission:
We reserve the right to allow admission into the Event venue and cancel Your participation at Our sole discretion.
9. Code of Conduct:
9.1 You agree to behave in such a way as to create a safe, supportive, learning environment while at the Event.
9.2 You agree not to smoke, drink alcohol or consume any hallucinogenic or banned drugs.
9.3 You agree not to engage in disruptive speech or behavior or otherwise interfere with the Event or other individuals’ participation in the Event.
9.4 You will comply with all applicable laws and agree not to engage in any form of harassing, offensive, discriminatory or threatening speech or behavior, including relating to race, gender, sexual orientation, religion or disability.
9.5 Participants engaging or threatening to engage in such behavior will be requested to leave the Event or related Event immediately, and such Participants will not be eligible to receive a refund of any fees paid towards their participation in the Event.
9.6 If You witness such behavior, please promptly contact an Event volunteer in order to take appropriate support.
10. Assumption of Risk:
10.1 You acknowledge and agree that Your attendance and participation in the Event is voluntary. You agree to assume the risks associated with attending and participating in the Event to the fullest extent permitted under applicable law.
10.2 To the extent permissible by law, You agree to indemnify Us against any and all claims, actions, losses and damages arising out of or relating to Your participation in the Event.
11. Information About You:
You consent to the collection and use of Your personal information that You provide in connection with the Event, by Us. We will use Your information to send details and announcements related to the Event to You. Any personal information that You provide to Us online will be handled in accordance with the laws and regulations of India. We are committed to protecting Your personal information and Your right to privacy. Our Privacy Policy governs the privacy policies of Our Site. 12. License to Use Items:
In consideration of the opportunity to participate in the Event, You grant Us an irrevocable, non-exclusive, royalty-free right and license throughout the world and in perpetuity to reproduce, edit, publish, distribute or translate, for promotional/educational purposes, all or any part of the following items ("Items"): (a) all still photographs (b) all audio and video recordings in connection with the Event. You consent to the use of the Items pursuant to the foregoing in perpetuity without compensation (unless prohibited by law) or additional consents from You and waive any moral rights You may have in the Items.
13. Waiver of Liability:
In consideration of being allowed to register for, and participate in the Event, You hereby warrant and represent that You are at least 10 years of age with parental consent or above 18 years of age and freely waive, release from liability, assume all risks, and covenant not to sue Us or Our members, employees, board members, agents, or volunteers for any expense, loss, damage, personal injury, including loss of life, disability, property damage, or property theft or actions of any kind that You may hereafter suffer or sustain before, during, or after the Event, unless the said expense, loss, damage, personal injury, including loss of life, disability, property damage or property theft or actions of any kind is caused by the sole, gross negligence of Us. This Waiver of Liability is specifically binding upon Your heirs and assigns and is knowingly given by You.
14. Force Majeure:
